Packer Update Doesn\'t Get the Blogosphere

Shhh...Here's What's Pissing Me Off...

Good ol' Packer Update, with it's unnamed sources and annonymous author, have added a fun new caveat at the end of each of their posts:

Do not repost articles. Reposting large portions of an article - even with a link - is still a violation of our copyright.

Now, I know I have linked back to the ol' update on occasion, and I have even used some of their own words when opining on their ideas. And that's the point - if you want to be a (relevant) part of the conversation, letting people copy your words so that they can illustrate your thinking for their audience is part of the deal. It even has the added bonus of prospective NEW READERSHIP finding  your precious content that you think is so valuable you find it necessary to add the two absurd sentences above to the end of every post.

Look, I understand wanting to protect your intellectual property, but when you basically throw crap against the wall to see what sticks under the guise of 'anonymous sources' and do it while you yourself remain annonymous, well, forgive my bluntness, but give me a fucking break. I mean, it's one thing for the Associated Press to go after bloggers, but for a BLOGGER to go after bloggers?

packer update is a joke. i emailed them once to get a fucking update and they said it was just for fun and they dont have time to write all the time

Not sure, but I suspect that what PU is upset about are message board posters who repost an entire articles and therefore deprive PU of hits.

Quoting reasonable excerpts seems like classic fair use.

Firstly, open your comments so you can defend your supposed secret information. Secondly, don't write about obscure and obviously out of the blue topics when other bloggers have touched on them the day before.

What I really want to know if there actually is a legal copyright there? Seems to me if you haven't filed for one, and don't have the appropriate court documentation, that it is illegal to say that you do.

I am not a legal expert of course, but I am pretty sure if you don't have the document you can't make the statement.

I am sure we will never know.

Every written work is copyrighted. If you file a work with the Library of Congress you get some additional benefits, but a work is copyrighted the second you create it.

DDD, you kind of got to what I thought I was getting to. Without that paperwork, you will never receive any damages.

Not so PackOne. It is only incumbent upon you to prove authorship, hence the practice known as 'poor man's copyright' where you mail yourself a copy of whatever you want protected (used to do this with lyric sheets and tapes for my bands' tracks) As they are postmarked with a date and sealed, it gives you 'evidence' to support your claim.

In this case, the Update has time-stamps and dates on each of his posts. As long as he can prove he owns the site and did indeed write the posts in question, he absolutely owns the copyright.

Okay, that makes sense and I am familiar with the poor man's copyright, so I imagine you are right. However, I was always told that no court will hear your case without filing the paperwork, and it didn't offer any kind of protections.

Not that it means its okay to steal if you won't get caught (we all know my stance on that).

The bottom line, for me anyway, is there is no way my place is going to make any money off of anyone else's stuff, much less my own.

Packer Update is a joke. Maybe if they would name one of their sources even ONCE, they would have an ounce of credibility. Aaron, you should read an e-mail they sent me after criticizing one of their articles. Maybe I'll send it to you, it's worth a laugh.

I imagine you are expecting some kind of bash here but it's not going to happen.

Very interesting album. It has this whole melding of Enya/Shamen/A-Ha/Pet Shop thing going on. It takes me back to a much happier time.

As a life long DJ and classically trained pianist, I found it pretty cool to listen to.

I am either going to make the beginning of 1 or 10 my ringtone (if they let you do that) they both are soothing to me.

Amazing what you learn about people some days.

Packeraaron, I'm beginning to see a pattern here...when someone does things a little different than you or has different ideas that are not the same as yours, you publicly thrash the person and the self-righteously cry out, "give me a fucking break." Yes I seem to remember similar language when I said on my own blog that Obama is a socialist...you have let Packer Update off pretty easily compared to what you tried to do to me. And, yet, what is this 'economic stimulus?' Is it not socialism? And how about stinking VLADIMAR PUTIN OF RUSSIA recently WARNING THE US of the DANGERS OF SOCIALISM, and to NOT GO DOWN THIS SOCIALISM ROAD?? (see it <a href="http://www.therightperspective.org/?p=1472" rel="nofollow">here.</a> Is your crowd so blind that PUTIN can see something you don't? Obviously so.

And so it may be that Packer Update does not have the same intention for his blog as you do on yours. Maybe he just writes some stuff because he loves the Green Bay Packers. Maybe he actually has a life. Because he doesn't live up to your personal standard of what a blog can or ought to be, does that make his efforts wrong? And, more importantly, does it then give you the right to attempt to humiliate him publicly? Forget the copyright ethics, what if your childish treatment of yet another fellow Packer-blogger actually finds you coming up short in the character department of an integrity standard? Should people author blog posts centering on your failures to meet such a standard, or are you the only one who gets to judge?

Does this type of insulting banter you toss up about other Packer bloggers somehow make you feel bigger than the person who authored that blog? Are you now 'one-up' on that guy? Wow...you're pretty impressive...you can insult another Packer blogger.

I guess like all the ethically-challenged people whom you love that now have their seats in the Oval Office and on Capitol Hill, you yourself don't see any problem with causing harm at another's expense, or getting your thrill on someone else's account.

Yup, your colors are shining brightly, packeraaron, just like Obama and the rest of the liberal, socialist crowd in power; only your colors aren't green and yellow - you're just yellow.

Since when do we start bashing the president on Packer blogs? This is a packer blog, right? You can't expect all Packer fans to be Republican...

Just because your not a best packer fan blog nominee doesn't mean you have to get so upset. I believe CHTV was actually applauding their blog and publishing links to their page for other CHTV viewers. This is a bad thing?

Well, thanks for letting me know that there was a Best Packer Fan Blog competition. But it sounds like your world is pretty small if you can evaluate my own personal motives without ever having met me, and can 'assume' that what fueled my comments had something to do with whatever hole you, yourself are looking out of. Or, you could actually try to comprehend what I said and evaluate the content and perhaps comment on the merits of its truthfulness or its deviation from truth. But of course, that would entail possessing values other than keeping your nose brown behind 'ol packeraaron, there, and thinking independently... well, never mind...I don't want to over- stress the connection between both your brain cells.

This part is actually true. You must file before you bring a suit, but not before an infringement. But if you don't file before the infringment you don't get statuatory damages---which is a set range of damages prescribed by statute---instead you must show that you were actually harmed in ecomonic terms (pretty tough to do for more blogs).

They have values based on integrity, or just decide to have a blog that they enjoy writing and don't try to be king of the blogosphere? That makes them some "dumb shit"? Dude, you've got a great blog, but apparently you have been believing your own press clippings, because if you believe that your blog is the measure of a man, unsurprisingly, you are again deeply deceived. Because calling out Packer Update like you did shows that a tiny little man lives behind Cheesehead TV. Don't dodge responsibility like you liberals have made an institution of - man up, for a change, and apologize to the guy who puts energy, effort and love into his blog, Packer Update, for trying to make him look like an idiot. That was a cheap shot, it ain't right, and you and your brown-nosed choir all know it.

Jesus, I take a few hours off to work and all hell breaks loose. Packsmack, I hear you dude and I respect your opinion, but I kind of like this blog because I find myself agreeing with a lot of what is written here. I like like what Aaron &amp; Corey bring, and isn't that what blogs are about - personal style and an approach that one enjoys reading?
Also, P1 gets the post of the year. I'm still howling...

Andrew, I agree, Cheesehead TV is an awesome blog with a lot to offer. And they would do just fine by showing some class and refraining from taking on the little guy like Packer Update. Eau Claire? Home of the Old Abes (mascot was a Civil-War era bald eagle; which was cool.) I was BORN there, but did not grow up there. But I do remember handing some of those EC cry-babies their lunch. But then I played college football with some of them and they turned out to be pretty good dudes. Pot-heads, though, most of them.

I have accused him of being way too cranky a couple of times. We agree mostly, but certainly not always. Anyway, I always appreciate a different perspective and hope you will post here more.
